NNDFN: General Meeting Report
The Oil & Gas Act requires Chance Oil & Gas to establish benefit agreements with VGFN and FNNND related to projects in the Traditional Territories. The benefit agreement was written by representatives of FNNND, VG, and Chance Oil & Gas. The benefit agreement was reviewed and is supported by legal advisors of both First Nations.
An important part of the benefit agreement is section 2.6. It indicates FNNND and VG may oppose any license or permit application by Chance Oil & Gas Ltd despite signing the benefits agreement. The section was an important part of the benefit agreement demanded by both First Nations’ representatives and supported by legal advisors.
The FNNND development corporation was included in early discussions when drafting the benefit agreement. The Yukon government issued multiple directives to Chance Oil & Gas to abandon particular wells and remediate the well sites. Chance Oil & Gas ignored the directives.
The Yukon government indicated Chance Oil & Gas may use the absence of the required benefits agreement to prevent prosecution regarding the failed directives.It is in both First Nations’ interests to ensure Chance Oil & Gas is prosecuted for the failure to abandon and remediate the wells by signing the benefits agreement.
Expedite the signing of the benefits agreement so the Yukon government can proceed with prosecuting the failure to abandon and remediate the wells noted in the directives.
