YT Government: Amendments to the Land Titles Act tabled

Today, Minister of Justice Tracy-Anne McPhee tabled Bill No. 11, proposing amendments that are intended to provide greater certainty to Yukon First Nations governments for the registration of Category A and B Settlement Land in the Yukon Land Titles Office.

Amendments to the Land Titles Act will expand the definitions of subsidiary certificate of title and development agreement, and recognize the authority of Yukon First Nations governments in respect of development agreements, plans of subdivision and approvals of air space plans.

Amendments to the Settlement Lands Regulation will be required to support the legislative changes.

Our government is committed to supporting Yukon First Nations governments to register their Settlement Land in the Land Titles Office in a way that does not impact Aboriginal rights and title. We are pleased to be working government-to-government to increase opportunities for land and economic development in Yukon.

  • The Land Titles Registry Working Group – which consists of Department of Justice staff, Kluane First Nation, Ta’an Kwäch’än Council and Champagne and Aishihik First Nations – developed a set of recommendations to address the concerns raised by First Nations governments regarding registration of Settlement Land at the Land Titles Office.
  • In 2018 the Kwanlin Dün First Nation received the first Certificate of Title for Category A Settlement Land from the Yukon Land Titles Office.
